Jolly Heating & Cooling ("we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you visit our website (jollyheating.com) or use our services.

By using our website or services, you agree to the collection and use of information in accordance with this policy.

1. Introduction

These Terms of Service ("Terms") govern your use of services provided by Jolly Heating & Cooling ("Jolly," "we," "us," or "our"). By requesting a quote, scheduling an appointment, or using our services, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use our services.

2. Services Provided

Jolly Heating & Cooling provides the following services in Metro Vancouver:

HVAC installations (heat pumps, furnaces, air conditioning, dual fuel systems, boilers, combi boilers)

Water heater installations (gas tanks, electric tanks, tankless water heaters, heat pump water heaters)

Maintenance and service calls

Emergency services

3. Quotes and Pricing

3.1 Quote Validity

All quotes are valid for 30 days from the date of issue. After 30 days, pricing may be subject to change due to material costs, labour rates, or other factors.

3.2 Non-Binding Estimates

Quotes are estimates and are not binding. Final pricing may vary based on site conditions, unforeseen complications, or changes to project scope discovered during installation.

3.3 Price Adjustments

Prices may be adjusted if:

The customer delays installation beyond the quoted timeline

Material costs or supplier pricing changes

Additional work is required beyond the original scope

We will notify you of any price changes before proceeding with the work.

4. Payment Terms

4.1 Deposit

A 50% deposit is required before the start of any installation project. The deposit secures your installation date and covers initial material procurement.

4.2 Final Payment

The remaining 50% balance is due upon system commissioning, typically 1-2 weeks after installation.

If the customer delays the commissioning visit, payment will be automatically due 30 days after installation, regardless of whether commissioning has occurred.

4.3 Accepted Payment Methods

We accept the following payment methods:

E-transfer

Credit card

Cheque

4.4 Late Payment

Accounts not paid within the agreed timeline are subject to:

10% annual percentage rate (APR) on overdue balances

Collection agency referral for accounts overdue by more than 90 days

A lien placed on the property for unpaid balances

5. Cancellation and Refund Policy

5.1 Customer Cancellation Before Work Begins

Customers may cancel their contract and receive a full refund of the deposit if:

No work has been performed

No materials have been ordered or delivered

Once work has begun or materials have been ordered, the deposit is non-refundable.

5.2 Cancellation After Work Begins

Customers cannot cancel once installation has begun. If extraordinary circumstances arise, cancellation will be assessed on a case-by-case basis, and customers will be responsible for:

Labour costs incurred to date

Materials purchased or delivered

Restocking fees (if applicable)

5.3 Cancellation by Jolly Heating & Cooling

We reserve the right to cancel a project if:

Required permits or strata approvals are denied

Site conditions make installation unsafe or impossible

The customer fails to meet their obligations under these Terms

In such cases, we will provide a full refund of any deposits paid, less any costs already incurred.

6. Scheduling and Rescheduling

6.1 Installation Scheduling

Once a deposit is received and any required approvals (permits, strata) are obtained, we will schedule your installation at a mutually agreed date and time.

6.2 Customer Rescheduling

Customers may reschedule their installation once at no charge, provided reasonable notice is given.

If a customer requests a second reschedule with less than 48 hours' notice, a $1,000 rescheduling fee may apply.

6.3 Jolly Rescheduling

We reserve the right to reschedule installations due to:

Weather conditions

Equipment or material delays

Crew availability or emergencies

We will notify you as soon as possible and work to reschedule at the earliest convenient date.

7. Warranty Terms

7.1 Standard Labour Warranty

Jolly Heating & Cooling provides the following standard labour warranties:

HVAC systems (heat pumps, furnaces, AC, boilers): 3 years

Rinnai tankless water heaters: 5 years

Hot water tanks (gas and electric): 1 year

7.2 Extended Labour Warranty

Extended labour warranty packages are available (paid or promotional) that extend coverage to 12 years for eligible systems.

Hot water tanks are not eligible for extended labour warranties.

7.3 Manufacturer Equipment Warranties

Equipment is covered by manufacturer warranties, which vary by brand and model. Warranty details are provided in your estimate.

7.4 Warranty Conditions

All labour and manufacturer warranties require annual maintenance to remain valid. If annual maintenance is not performed, warranties may be void.

If a customer skips annual maintenance, warranty coverage will be assessed on a case-by-case basis at our discretion.

7.5 What Is NOT Covered Under Warranty

Warranties do not cover:

Damage caused by customer misuse, neglect, or failure to maintain equipment

Lack of regular maintenance (e.g., filter changes, annual tune-ups)

Damage from external factors (flooding, fire, electrical surges, freezing, pests, extreme weather)

Normal wear and tear on consumable parts (filters, batteries, thermostats)

Modifications or repairs performed by non-authorised technicians

Relocation or reinstallation of equipment

Issues arising from inadequate ventilation, airflow, or home insulation

Pre-existing conditions or defects in ductwork, electrical systems, or home structure

Cosmetic damage (scratches, dents, discolouration) that does not affect performance

Acts of God or events beyond our reasonable control

This list is not exhaustive. Warranty coverage is determined at our discretion based on the specific circumstances.

8. Customer Responsibilities

By using our services, you agree to:

Provide accurate information about your home (size, layout, existing equipment, electrical capacity)

Ensure site access on installation day (clear pathways, parking, access to mechanical rooms)

Obtain any required strata or building approvals before installation (we can assist with applications)

Maintain equipment according to manufacturer guidelines and schedule annual maintenance to keep warranties valid

Ensure payment is made according to the agreed schedule

Notify us immediately of any issues or concerns with the installed system

9. Limitation of Liability

9.1 No Responsibility for Pre-Existing Conditions

Jolly Heating & Cooling is not responsible for:

Pre-existing issues with ductwork, electrical systems, plumbing, or home structure

Hidden defects discovered during installation

Delays caused by third parties (permit offices, strata boards, suppliers, manufacturers)

9.2 Indirect Damages

We are not liable for indirect, incidental, or consequential damages, including but not limited to:

Lost income or business interruption

Discomfort due to heating or cooling outages

Damage to personal property (unless caused by our negligence)

9.3 Maximum Liability

Our maximum liability under any contract is limited to the total amount paid by the customer for the services rendered.

10. Rebate Assistance Disclaimer

Jolly Heating & Cooling may assist customers with rebate applications for programmes such as CleanBC and FortisBC. However:

We do not guarantee rebate approval or rebate amounts

Customers are ultimately responsible for verifying their own eligibility

Rebate programme terms and conditions are set by the respective organisations (CleanBC, FortisBC) and are subject to change

We are not liable for denied rebate applications or changes to rebate programmes

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of British Columbia, Canada.

11.2 Dispute Resolution

In the event of a dispute, both parties agree to first attempt resolution through mediation. If mediation is unsuccessful, disputes will be resolved through binding arbitration or the courts of British Columbia, as appropriate.

11.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit.

12. Intellectual Property

All content on the Jolly Heating & Cooling website, including text, images, logos, and materials, is the intellectual property of Jolly Heating & Cooling and is protected by copyright laws.

You may not reproduce, distribute, or use any content without our express written permission.

13. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated "Effective Date."

Updated Terms apply to new contracts and do not affect existing contracts unless otherwise specified.
